Section 34 Amendments: Technical and Policy Amendments

Under Section 34 of the Clean Water Act, 2006 a Source Protection Authority may propose an amendment to a Source Protection Plan, if the Source Protection Authority consults with the Source Protection Committee about the proposed amendment, and the Source Protection Authority and the Source Protection Committee are both of the option that the amendment is advisable. Members of the public are invited to comment on the proposed updates to the CTC Source Protection Plan. The source protection program is designed with continuous improvements in mind. Amendments are being proposed to the CTC Source Protection Plan and Credit Valley SPA Assessment Report to include updates to the Town of Erin Drinking Water System.

The current drinking water supply for the Erin Drinking Water System is sourced from groundwater, supplied through two municipal wells PW E7 and PW E8. To address existing water demands and future growth projections, the Town of Erin has proposed to add a new well (E9) to their drinking water system. This proposed supply well is located north of Sideroad 17 on Wellington County Road 23 (9th Line), within the West Credit River subwatershed in the Credit River Watershed. This has resulted in new Well Head Protection Areas within the Town of Erin.

This proposed amendment includes updates to drinking water systems in Peel Region, York Region, and City of Toronto. Policy revisions are also proposed for certain types of chemicals (DNAPLs & organic solvents) as well as to the existing threat activity definition, transition and timelines policies.

This amendment involves the addition of a new municipal drinking water supply well in Aurora and the removal of a municipal supply well in Newmarket, resulting in an expansion of vulnerable areas into the Toronto and Region Source Protection Area.

Section 51 Amendments: Typographical and Other Changes

Under the Clean Water Act, 2006 O. Reg. 287/07, an amendment can be made to correct the following in an assessment report or source protection plan:

  1. An amendment that is made to correct a clerical, grammatical or typographical error.
  2. An amendment that is made to alter the style or presentation of text or graphics in order to improve electronic or print presentation.
  3. If the source protection plan contains a provision that is contingent on the occurrence of a future event and the event occurs, an amendment that is made to remove the text referring to the contingency and to make any related changes.
  4. An amendment that is made to change references to a name, title, location or address if the name, title, location or address of a body, office, person, place or thing has changed.
  5. An amendment that is made to correct errors in the numbering of provisions of the source protection plan and any related changes in cross-references.
  6. An amendment that is made to correct errors, if it is patent that an error has been made and what the correction should be.
  7. An amendment to update the assessment report portion of the source protection plan to reflect the results of a risk assessment.
  8. An amendment that is made to a source protection plan to account for the discontinuation of the use of a well or surface water intake related to a drinking water system that is referred to in the source protection plan.
  9. An amendment that is made to a source protection plan to account for a change in the terminology used in the Tables of Drinking Water Threats. O. Reg. 246/10, s. 12; O. Reg. 206/18, s. 5 (1).
